Construction Law in Saudi Arabia

Saudi Arabia’s legal system is based on the principles of Sharia Law which, following the literal interpretation of the teachings of the Qur’an. The way in which Saudi courts regulate contractual relationships is therefore extremely different from the common and civil law systems.  Parties are of course free to contract with each other; however, the degree of freedom with which they can do so is governed by certain prohibitions in the Qur’an.  Generally speaking, contractual provisions that violate the fundamental principles of Sharia law will not be enforced by the Saudi courts. 1. General 1.1 Governing Law The United Arab Emirates is a civil law country that follows a Civil Code. The law is a codified established comprehensive legal framework that governs most eventualities.  Dubai is bound by both the federal laws of the UAE and laws specific to the Emirate of Dubai.
